Business terms and conditions

Product search: You can find product by using search engine, that is placed on the right shopping banner of the website. Type desired product into the searchbox and searched products will be shown in the middle of the screen, along with the image and price. You can search for products by product groups in category column. Simply choose desired category, in which subcategories from which you can chose, will be shown.

Presentation of product and service: Each product or service is presented with basic as well as additional information: product name, image, short description, longer description, additional data (colour, size, composition, maintenance instruction, etc.), price and product rating option. If you want to add desired product or service to cart, simply click on the button »Buy now«.

Shopping cart: Shopping cart has the same role as the cart in a regular store, namely it is saving chosen products and it shows their (quantity). The shopping cart content can be reviewed any moment and you can add or delete chosen products any time. You can change the quantity of selected product by pressing the button »recalculate quantity«, according to changed quantity, recalculated total purchase value will be shown. Products can be removed from the cart anytime by pressing the button »remove (X)«.

Purchasing process: If you’re certain that you would like to purchase the products that are placed in the cart, click on the button »Make a purchase«. The system will redirect you to the form, in which you enter required data. After you’ve entered your data and the delivery address data, simply confirm the entered data by clicking the button »next step«. The system redirects you to the form, in which you choose payment and delivery method.

Delivery: We dispatch all products that are in stock (which is stated by the individual product), within 2-7 working days after your order. We do not dispatch the goods on Sundays and public holidays. In case of special requirements, please type the latter under the notes on the bottom order. All information can be provided by phone.

All contracts for Slovenian citizenship are concluded in Slovenian language, and for other residents of the European Union in English. The products that are out of stock, will be shipped to you by prior arrangement with you. We will contact you by phone or by email.

Delivery costs: The goods will be delivered by the company DPD with which we have a contract. Because we know that your payment security comes first, we offer you 100% secure payment in online store upon receipt of goods. When the delivery person brings the goods to you, you will pay for the goods in cash (if you choose cash on delivery). Your cost will be exactly as it will be stated on your order, confirmed order will later be sent to your e-mail.

If you decide to pay by proforma invoice, it is necessary to mark the option of payment by proforma invoice in your order. Postage cost is EUR 4.90, regardless of the purchase quantity. We cover postage that is over 150.00 EUR. In case of special requirements, please enter them under the notes at the bottom of the order. By clicking on the “Preview invoice” button, you look at the order again and if everything is OK, confirm the order by clicking on the “Complete purchase” button. If you have entered your correct e-mail address in the data, you will receive an electronic confirmation of receipt of the order after the purchase procedure.

Prices and VAT: Prices in the online store are indicated in euros. VAT is calculated in prices according to the provisions of the Value Added Tax Act.

Confidentiality of data: Wine Fountain, needs some of your personal information to fulfill the order correctly. We will keep all information confidential and will never pass it on to third parties. The catalog of the personal data file is registered with the state supervisory body and published in the register of personal data files.

Withdrawal from the order: The Consumer Protection Act (CPA) stipulates that in the case of distance or off-premises contracts, the consumer has the right to inform the company within 14 days that he is withdrawing from the contract, without having to state the reason for your decision. The consumer shall bear only the costs of returning the goods in connection with the withdrawal. In the case of a sales contract, the withdrawal period of 14 days begins to run from the day on which the consumer acquires actual possession of the goods.

With the exercise of the right to withdraw from the contract from Article 43. CPA, the obligations of the parties regarding the fulfillment of the contract or the conclusion of the contract cease when the consumer has made an offer to conclude the contract. In the event of withdrawal from the contract, the company shall immediately or no later than 14 days after receipt of the notice of withdrawal from the contract return all payments received. The company returns the received payments to the consumer with the same means of payment as used by the consumer, unless the consumer has explicitly requested the use of another means of payment and the consumer does not incur any costs as a result. The consumer cannot claim reimbursement of additional costs incurred if he has explicitly opted for a type of shipment other than the most affordable standard shipment offered by the company. In sales contracts, the company may withhold the refund of payments received until the returned goods are accepted or until the consumer provides proof that the goods have been returned, unless the company offers the option to take over the returned goods itself. If the consumer has already received the goods and withdraws from the contract, he shall return them or hand them over to the company or a person authorized by the company to take over the goods, immediately or no later than 14 days after notification of withdrawal.

The consumer is considered to return the goods on time if he sends them before the expiry of the 14-day return period. Where, in the case of a contract concluded off-premises, the goods are delivered to the home at the time of the conclusion of the contract, the company takes them over at its own expense, if due to the nature of the goods it is not possible to return them by post. The consumer is liable for a reduction in the value of the goods if the reduction in value is the result of conduct which is not necessarily necessary to establish the nature, characteristics and functioning of the goods. In order to exercise the right to withdraw from the contract, the consumer must inform the company by an unequivocal statement (enter name, physical address and, if possible, telephone number, fax number and e-mail address of the company) of his decision to withdraw from the contract (sent by post, letter, fax or e-mail).

Product return: In our store we take care of the quality of the goods. In the event that you receive a product that does not meet your wishes or needs, we will be happy to replace it with another or refund your money. Undamaged and in unaltered quantity, you can return it without hesitation within the legal deadline.

Of course, you can also replace the product. Send it back to us and we will send you another item. In this case, we will cover the cost of shipping the new item. The consumer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased without the consumer’s fault.

The consumer may not use the items without hindrance until the withdrawal from the contract. The consumer may inspect and test the articles to the extent strictly necessary to establish the actual situation. The consumer is liable for a reduction in the value of the goods if the reduction is the result of conduct not necessarily necessary to establish the nature, characteristics and functioning of the goods.

Warranty: All items in the e-shop have a warranty guaranteed by Fontana vin – Vodole (Sozvočje d.o.o.), Vetrinjska 10, 2000 Maribor. The warranty period is stated for each item separately and is included with the product.

Material error: Familiarization with the company’s liability for material errors The Consumer Protection Act stipulates that the seller must deliver the goods to the consumer in accordance with the contract and is liable for material errors of its fulfillment.

The error is real:

  • if the thing does not have the properties necessary for its normal use or for marketing;
  • if the thing does not have the properties necessary for the special use for which the buyer is buying it, but which was known to the seller or should have been known to him;
  • if the thing does not have the properties and qualities that were explicitly or tacitly agreed or prescribed;
  • if the seller has delivered a thing that does not match the pattern or model, unless the pattern or model was shown for notice only. The suitability of goods for normal use shall be assessed in the light of normal goods of the same kind and taking into account any seller’s statements on the characteristics of the goods made by the seller or manufacturer, in particular through advertising, product presentation or indications on the goods themselves.

The provisions of the law governing obligations shall apply to liability for material errors, unless this law provides otherwise. The consumer may exercise his rights arising from a material defect if he notifies the seller of the defect within two months of the day on which the defect was discovered. The consumer must describe the defect in more detail in the error notice and allow the seller to inspect the thing. The consumer may notify the seller of the defect in person, of which the seller must issue a certificate, or send it to the store where the item was purchased, or to the seller’s representative with whom he has concluded a contract.

The seller is not liable for material defects in the goods that appear after two years have elapsed since the thing was delivered. A defect in things shall be deemed to have already existed at the time of extradition if it occurs within six months of extradition. The consumer, who has correctly informed the seller of the defect, has the right to require the seller to:

  • rectify the defect on the goods or
  • returns part of the amount paid in proportion to the error or
  • replace defective goods with new faultless goods or
  • returns the amount paid.

In any case, the consumer also has the right to demand compensation from the seller, and in particular reimbursement of costs of materials, spare parts, labor, transfer and transport of products arising from the fulfillment of obligations under the previous paragraph of this article. The consumer’s rights referred to in the first paragraph shall expire two years from the day on which he informed the seller of the material defect.

If the existence of a defect in the goods is not disputed, the company must comply with the consumer’s request as soon as possible, but no later than within eight days. The company must respond in writing to the consumer’s request no later than eight days after receipt, if the existence of a defect in the goods is disputed.

Invoicing: You will receive a itemized invoice next to the package. The invoice is located in the cover affixed to the package. If you do not receive the invoice, we can send it to your e-mail address. Upon personal collection, you will receive an invoice along with the products.

The online store www.winefountain.eu makes every effort to fulfill its duty to provide an efficient complaint handling system.
